While disability is not a popular topic, social security disability is an area that necessitates attention. According to the Social Security Administration, studies show that a 20-year-old worker has a 3 in 10 chance of becoming disabled before reaching retirement age. Social Security pays benefits (SSI - Supplemental Security Income) to people who cannot work because they have a medical condition that is expected to last at least one year or expected to result in death.

The first step in receiving SSI disability benefits is to file your initial social security claim with your local Social Security Administration office. Unfortunately, you will usually be denied SSI or social security benefits upon your initial application. If you are denied social security benefits, you then have only 60 days to file your first appeal, the Request for Reconsideration. If you are approved for SSI benefits, you will receive social security benefits dating back to the onset date of your injury. If this SSI appeal is denied, you then must file a Request for Hearing. This hearing will be before an Administrative Law Judge. The Administrative Law Judge will then render an opinion regarding your social security disability claim and award or deny you social security disability benefits. If you are denied social security disability benefits by the Administrative Law Judge, you may then appeal to the Social Security Appeals Council. The Appeals Council will either affirm the ruling of the Administrative Law Judge or remand the case back to the hearing stage. If the Administrative Law Judge's social security disability ruling is upheld, you may then appeal in United States District Court.

It is crucial that you adhere to the time limits imposed by the Social Security Administration. If you do not follow the exact steps to appeal and adhere to the time limits imposed, you will have to begin the process from the beginning. Our social security law experts work with you during all phases of the Social Security legal process. You have a right to representation by a Social Security Attorney. Our social security lawyer experts recommend that you hire competent legal representation to handle your Social Security claim.

Crone & Mason, PLC, a leading social security disability law firm, zealously advocates for individuals who are disabled. We represent social security law clients from the initial application up to Federal Court Appeals. Our fee is 25% of any back benefits you receive after you are granted disability plus expenses. If your social security benefits are not approved, you do not owe attorney's fees or expenses.

According to the Social Security Administration, a "Disability" can be a physical, or emotional condition. In order to win social security disability benefits, you must have a disability that is severe enough to keep you from working in any regular paying job for at least 12 consecutive months. The test for eligibility for social security disability benefits is not whether you can go back to a job you've lost or if you've been able to find a job recently.
